Terms of Use

These Terms of Use govern the relationship between the MamãoFy platform (accessible at mamaofy.com.br) and its users. The official support channel is [email protected].

For the purposes of these Terms, the following terms have the meaning indicated:

• Platform: the set of systems, applications, interfaces and services made available at mamaofy.com.br
• User: any person who accesses the platform, with or without registration
• Student: user who purchases access to courses, content or plans as a learning consumer
• Instructor: user registered as a content creator who publishes and commercializes courses, classes or services on the platform
• Organization: company or entity that uses the platform for internal or external learning management, with multiple linked users
• Content: any material published on the platform, including videos, texts, documents, quizzes, complementary materials and certificates
• AI Credits: prepaid consumption units used to access the platform's artificial intelligence functionalities
• Plan: recurring subscription modality that determines the resources available to the user or instructor

MamãoFy is a learning management platform (LMS) that enables the creation, distribution and management of educational content. Our services include:

• Courses and content: creation, publication and consumption of online courses, live classes, complementary materials and digital certificates
• MamãoFy.X: exclusive member area for students with access to purchased content, learning progress and community
• MamãoFy.AI: set of artificial intelligence tools for content creation, planning and productivity (Creative AI, Tutor AI, Social Planner)
• MamãoFy.In: public instructor profile with portfolio and available courses
• Workspace: project management tools with Kanban boards, collaborative notes, mind maps and task lists
• Landing Pages: lead capture and sales page builder for instructors and organizations
• Sender: marketing automation module, email and WhatsApp campaigns, and conversion funnels
• Meetings: scheduling and delivery of consultations, mentoring and live individual or group sessions
• Store: sale of physical or digital products complementary to courses

To use certain features of the platform, you must create an account. By creating your account, you declare and agree that:

• You have full legal capacity or authorization from legal guardians, in case you are under 18 years of age
• You will provide true, accurate, current and complete information during registration and will keep such data up to date
• You are responsible for maintaining the confidentiality of your access credentials (email and password) and for all activity carried out in your account
• You will immediately notify MamãoFy by email at [email protected] of any unauthorized use of your account
• You will not create more than one personal account; duplicate or fraudulent accounts may be terminated without prior notice
• Login via social networks (Google, Facebook) is subject to the terms of use of each external provider

MamãoFy reserves the right to refuse registration or suspend accounts that contain false, incomplete information or that violate these Terms.

MamãoFy offers different access modalities for instructors and organizations:

• Starter Plan — R$ 49.90/month: access to essential functionalities for individual beginner instructors, with student, course and AI resource limits defined at the time of contracting
• Business Plan — R$ 195.90/month: expanded access with greater student capacity, unlimited courses, advanced marketing tools and complete AI resources
• Organizations Plan (Orgs): customized solution for companies and educational institutions, with pricing and functionalities negotiated individually

AI Credits are prepaid consumption units for use of artificial intelligence functionalities (MamãoFy.AI, Creative AI, Social Planner). They are sold in packages from R$ 50 to R$ 500 and have a validity defined at the time of purchase. Credits not used within the validity period are non-refundable.

About subscriptions:

• Billing is made automatically in the chosen monthly or annual cycle, unless cancellation is made up to 24h before renewal
• You can cancel automatic renewal at any time through your account panel, keeping access until the end of the already paid period
• Plan changes are calculated with proportional credit for the remaining days of the previous plan
• Subscription cancellation does not generate a refund for the current period, except when required by law
• MamãoFy may change plan values with 30 days prior notice, without affecting the current cycle

When commercializing courses, products or services through the MamãoFy platform, the instructor agrees to the following fee structure applied to each approved transaction:

• 6% — Platform commission: fee charged by MamãoFy for hosting, infrastructure, payment processing and content commercialization support
• 4% — Student maintenance fee: fee charged on the student's share to cover operational costs related to access, support and learning experience
• 2% allocated to social cause: of the 10% total retained, 2 percentage points are directed to social and educational projects supported by MamãoFy, as periodically communicated on the platform

The instructor therefore receives 90% of the gross value of each sale, after deducting the above fees. Eventual payment gateway fees (charged by MercadoPago or other processors) are calculated on the gross amount before the transfer and may vary according to the payment method chosen by the buyer.

Fees may be revised by MamãoFy with 30 days prior notice. Continued use of the platform after the notice implies agreement with the new structure.

When making a purchase on MamãoFy, you agree to the following conditions:

• Prices are displayed in Brazilian Reais (BRL) and may include applicable taxes according to current legislation
• Payments are processed by MercadoPago (main gateway) and may also be processed by Stripe, PayPal or other gateways enabled by the instructor
• MamãoFy does not store credit card data on its servers; all tokenization is carried out directly by the payment gateway
• Installment purchases are subject to interest and conditions defined by the gateway and the card brand
• PIX payments are valid for 30 minutes after the QR Code is generated

Refunds: in accordance with Art. 49 of the Brazilian Consumer Defense Code (Law 8.078/1990), the student is entitled to a full refund within 7 calendar days after the purchase date for acquisitions made outside commercial establishments (online purchases). After this period, refunds are subject to the specific policy of the instructor or organization. To request a refund, contact [email protected].

Withdrawals and transfers to instructors:

• Courses and products: the available balance can be requested after 7 calendar days from the sale date, the period necessary to cover the withdrawal period
• Meetings: the balance becomes available after 2 calendar days from the confirmed meeting realization
• Transfer is made via bank transfer (TED/PIX) to the account registered by the instructor, upon request in the platform panel
• Withdrawals may be subject to minimum value and bank processing times

When publishing, submitting or making available any content on the platform (courses, videos, materials, texts, comments, reviews, forum posts), you:

• Declare that you have the necessary rights over the published content and that its publication does not violate third-party rights
• Grant MamãoFy a non-exclusive, free, worldwide and sublicensable license to host, store, display, reproduce and distribute the content strictly within the platform and for the purposes of providing the contracted services
• Maintain full ownership of intellectual property rights over the content you created
• Are entirely responsible for the quality, accuracy, currency and legality of the published content
• Authorize MamãoFy to use the instructor's name, image and/or logo for the purposes of promoting the platform and registered courses, unless expressly stated otherwise

MamãoFy does not edit nor take responsibility for content created by instructors and users. Content that violates these terms may be removed without prior notice and the respective instructor may have their account suspended.

MamãoFy offers artificial intelligence tools integrated into the platform (MamãoFy.AI, Creative AI, Tutor AI, Social Planner), powered by external providers (xAI and OpenRouter). By using these functionalities, you agree that:

• AI-generated content is produced automatically and may contain inaccuracies, errors or outdated information. MamãoFy does not guarantee the accuracy or adequacy of the generated results
• You are solely responsible for reviewing, editing and using AI-generated content before publishing or sharing it
• It is prohibited to use AI tools to generate illegal, misleading, defamatory, discriminatory content or content that violates third-party rights
• Data entered into AI tools (prompts, texts, files) may be processed by the servers of AI providers (xAI in the USA and OpenRouter), as detailed in our Privacy Policy
• MamãoFy does not claim copyright over content generated by AI tools on behalf of the user, with responsibility for the final content being entirely that of the user who publishes it
• Consumption of AI tools is subject to monthly limits defined by the active plan or by the amount of AI Credits available in the account

It is strictly prohibited to publish, share, promote or use the platform for any content or activity that is:

• Illegal: that violates Brazilian federal, state or municipal laws or applicable international regulations
• Offensive or harmful: pornographic, defamatory, slanderous, injurious, threatening, or that incites violence or self-harm
• Discriminatory: racist, xenophobic, homophobic, transphobic, ableist or that promotes discrimination of any nature
• Misleading or fraudulent: false information, spam, phishing, financial pyramids or illicit enrichment schemes
• Rights-violating: that infringes copyrights, trademarks, patents or any other form of third-party intellectual property
• Privacy-invasive: disclosure of third-party personal data without authorization, non-consented recordings or unauthorized exposure of images
• Malicious: viruses, malware, harmful scripts or any code that may damage the platform or the devices of other users

Violations will result in immediate removal of the content, suspension or termination of the account, without the right to a refund, and possible applicable legal measures.

All content on the MamãoFy platform that is not authored by instructors or users — including texts, graphics, logos, icons, images, interface design, source code and software — is the property of MamãoFy or its licensors and is protected by copyright, trademark and intellectual property laws.

It is not permitted to copy, reproduce, modify, create derivative works, distribute, reverse engineer or use any element owned by MamãoFy without prior and express written authorization. Unauthorized use may result in legal action.

The instructor retains full ownership over the content they created and published on the platform. MamãoFy has only the license of use described in Section 7 of these Terms.

If you identify content on the platform that you believe violates your copyright, please contact us by email at [email protected] with the information necessary for analysis and eventual removal.

MamãoFy provides an affiliate program that allows registered users to promote instructors' courses and products and receive commissions on sales made through their trackable links.

• Participation in the affiliate program is voluntary and subject to approval by the instructor responsible for the course or product
• Affiliate commissions are defined by the instructor of each product and displayed in the program panel
• The affiliate receives their commission after the buyer's withdrawal period expires (7 days), following the same withdrawal flow as instructors
• Affiliates are prohibited from using deceptive practices, spam, false advertisements or any fraudulent method to promote the products
• MamãoFy has no institutional relationship with Facebook, Instagram, Google, TikTok or any other third-party platform. The affiliate is responsible for respecting the terms of use of each social network they use for promotion
• MamãoFy reserves the right to terminate access to the affiliate program in case of misuse or violation of these terms

The platform allows two or more instructors to collaborate in the creation and commercialization of the same course or product, with configurable revenue split among co-creators (revenue split).

• The main instructor is responsible for defining the revenue split percentages among collaborators, before publishing the content
• All collaborators must expressly accept the collaboration terms before receiving any transfer
• MamãoFy carries out transfers individually to each collaborator according to the agreed percentage, after deducting the fees provided in Section 5
• Disputes between collaborators about revenue split or content authorship are the sole responsibility of the parties involved. MamãoFy does not act as an arbitrator in these relationships
• In case of removal of a collaborator from the project, the main instructor assumes full responsibility for the published content

To the maximum extent permitted by Brazilian legislation, MamãoFy will not be responsible for any indirect, incidental, special, consequential or punitive damages, including but not limited to:

• Loss of data, lost profits or business interruption
• Quality, accuracy or legality of content published by instructors or other users
• Temporary unavailability of the platform due to scheduled maintenance or technical incidents
• Third-party actions (including hackers, external providers or payment gateways) that affect the platform or its users
• Results obtained or not obtained by the student based on the acquired content
• Failures in integrations with third-party services (social networks, external tools, AI providers)

MamãoFy's total liability, in any circumstance, is limited to the amount paid by the user in the 3 months prior to the event that caused the damage. The use of the platform is at your own risk. Services are provided "as is" and "as available".

MamãoFy has no institutional relationship with Facebook, Instagram, WhatsApp, Google, TikTok, LinkedIn, Pinterest or any other third-party platform.

When addressing financial matters in any of our products and content, we strive to provide means that contribute to the growth of your business and improve your quality of life. However:

• We do not claim nor guarantee that you will make money using our products and services
• The income generation process and results depend on your personal skills, experience, dedication and a number of variables beyond our control
• There are significant risks in any digital enterprise, especially in an online environment, where market and platform changes happen frequently
• MamãoFy is not responsible for your financial success or failure under any terms

Carefully consider all aspects and risks before acquiring or commercializing products on the platform. We advise you to make buying and selling decisions wisely and, when necessary, consult specialized professionals.

MamãoFy reserves the right to suspend or terminate your account, with or without prior notice, if:

• You violate any provision of these Terms of Use or any other platform policy
• Your use of the platform represents a security risk to other users or to the platform infrastructure
• Your registration information is false, fraudulent or incomplete
• You use the platform for illegal or unauthorized purposes
• There is suspicion of fraud in financial transactions carried out on the platform

You may also request the voluntary termination of your account at any time through the settings panel or by email at [email protected]. Termination of the account does not extinguish pending financial obligations. Data will be treated according to our Privacy Policy and the LGPD (Brazilian General Data Protection Law).

MamãoFy reserves the right to modify these Terms of Use at any time. Relevant changes will be communicated with a minimum of 15 days in advance by email or platform notification. Changes arising from legal obligations may take effect immediately.

Continued use of the platform after the effective date of the changes constitutes your acceptance of the new provisions. If you do not agree with the changes, you may terminate your account before the effective date.

These Terms of Use and other legal documents published on the platform constitute the entire agreement between you and MamãoFy regarding the use of the services.

These Terms of Use are governed by and interpreted in accordance with the laws of the Federative Republic of Brazil, especially the Consumer Defense Code (Law 8.078/1990), the Brazilian Internet Civil Framework (Law 12.965/2014), the General Data Protection Law (LGPD — Law 13.709/2018) and the Brazilian Civil Code (Law 10.406/2002).

All disputes arising from or related to these Terms will be submitted to the jurisdiction of the district of MamãoFy's headquarters, excluding any other, no matter how privileged, except for cases where consumer legislation determines a different jurisdiction in favor of the consumer.
